Terms of Use

The rules for using Crayon Years, in plain words. They sit next to Apple's standard licence, which applies to every App Store app.

Last updated Draft, pending legal review

The short version

  • Your drawings are yours. They live in your own iCloud and we never get a copy.
  • Apple handles every payment, renewal, cancellation and refund.
  • If you stop paying, you can still view and export everything, forever.
  • Only invite people you trust to a shared gallery, and only share what you may share.

Who we are

Crayon Years is made by Zeus Apps B.V., the Netherlands. In these terms, "we" means Zeus Apps B.V. and "you" means the person using the app or this website. By using Crayon Years you agree to these terms.

Your licence to use the app

You download Crayon Years from Apple's App Store, so Apple's Licensed Application End User License Agreement applies to it. These terms add to that agreement. They don't replace it.

We give you a personal, non-exclusive, non-transferable licence to use Crayon Years on iPhones and iPads that you own or control, as the App Store rules allow. You may not sell, rent or redistribute the app, or copy or reverse engineer it beyond what the law allows.

Free and Pro

Crayon Years is free to download. Free keeps 24 new drawings a year for unlimited children, imports included. The count renews each year on the day you started, not on 1 January.

Pro adds unlimited drawings, sharing with the other parent and grandparents, all widgets, StandBy and Frame mode, and the yearly recap and print-ready book. What Pro includes is described on the pricing section and in the app before you buy.

Subscriptions, the free trial and refunds

Pro is sold through Apple, with your Apple ID, as a yearly subscription (€19.99), a monthly subscription (€2.99) or a one-time purchase (€44.99). Prices can differ by country and include tax where it applies. The App Store shows the exact price before you confirm.

  • Free trial. The yearly plan starts with 14 days free. We remind you 2 days before it ends. If you don't cancel at least 24 hours before the end of the trial, Apple charges the yearly price.
  • Renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before. Apple charges your Apple ID for the next period.
  • Cancelling. Open Settings on your iPhone, tap your name, then Subscriptions. Pro stays on until the end of the period you paid for. Cancelling never deletes a drawing.
  • One-time purchase. You pay once and keep Pro for as long as Crayon Years is offered on the App Store, on every device with your Apple ID.
  • Refunds. Apple takes the payment, so only Apple can give a refund. Ask at reportaproblem.apple.com. We can't refund App Store purchases ourselves.
  • Price changes. If a subscription price ever goes up, Apple tells you first and asks for your consent where the rules require it.

Nothing in these terms takes away the rights you have as a consumer under the law of your country.

Family Sharing

Pro works with Apple Family Sharing. When you turn on purchase sharing, one purchase covers the members of your Apple family group, within the limits Apple sets. Family Sharing is separate from sharing a gallery: people you invite to a gallery never need to pay, because the owner's Pro covers them.

Your drawings stay yours

Everything you add, from drawings and photos to titles, names, portraits and voice notes, belongs to you (or to your child, or whoever made it). We claim no rights to it. We don't need a licence to it either, because we never receive it: Apple stores it in your own iCloud, under Apple's iCloud terms.

You can export every original as a ZIP, or the whole gallery as a PDF, at any time, on Free or Pro. iCloud storage space is between you and Apple. If your iCloud is full, new drawings wait on your phone until there is space.

Shared galleries

As the owner of a gallery, you choose who to invite and with which role. Everyone you invite can see every drawing in it. Co-parents can add, edit and delete drawings and keep a copy in their own iCloud. Viewers, such as grandparents, can look, send hearts and record voice reactions.

You are responsible for who you invite and for what you share. Only add art and photos you have the right to share, and ask other parents before you add pictures of their children. Viewers need write access in iCloud to send hearts, so someone tech-savvy could still delete a drawing outside the app. Invite people you trust. Deleted drawings can be restored for 30 days.

When you remove someone, or someone leaves, a co-parent keeps their own copy. How sharing works in detail is on the families page.

Acceptable use

Crayon Years is for keeping and sharing family artwork and memories. Please don't use it to:

  • store or share anything illegal, or anything that harms, exploits or endangers a child;
  • harass, threaten or upset other people in a shared gallery, including through voice reactions;
  • share content you don't have the right to share;
  • break, overload or get around the app's security, purchases or limits.

We can't see what is in your gallery. Apple's own terms for iCloud also apply to what you store there.

Changes to the app

We keep improving Crayon Years, so features can change, move between Free and Pro for new buyers, or be retired. If you already paid for Pro, we won't take away its core: unlimited drawings and sharing. Crayon Years depends on Apple services such as iCloud and the App Store, which we don't control. Drawings are always saved on your phone first, so an iCloud outage doesn't lose them.

Liability

We build Crayon Years with care, but we can't promise it will always be free of errors or available without interruption. As far as Dutch law allows:

  • we are not liable for indirect or consequential loss;
  • we are not liable for loss caused by Apple services, your device, your iCloud account or your iCloud storage;
  • our total liability is limited to the amount you paid for Crayon Years in the 12 months before the event.

None of this limits liability for intent or gross negligence, or any liability or consumer right that cannot be limited by law.

Ending these terms

You can stop at any time by deleting the app. Deleting the app does not cancel a subscription, so cancel that in Settings too. Your drawings stay in your iCloud until you delete them. If you seriously break these terms, we may end your licence to use the app.

Governing law and disputes

Dutch law applies to these terms. Disputes go to the competent court in the Netherlands. If you live in another EU country, you keep the protection of the mandatory consumer law of that country and can also go to your local court. Please write to us first. Most problems are quicker to solve by email.

Changes to these terms

When these terms change, we update the date at the top. If a change matters to you, we tell you in the app before it applies.
